Overview

Welcome to TTS CLINICAL (a brand of TTS RENOVANCE LLC). The terms "we," "us," and "our" refer to TTS CLINICAL. We operate this website and online store, together with all related content, features, tools, products, and services (collectively, the "Services"). Our store is hosted by Shopify, which provides the e-commerce platform that allows us to offer the Services to you.

These Terms of Service (the "Terms"), together with the policies referenced in them — including our Privacy Policy, Refund & Return Policy, Cancellation Policy, and Shipping Policy, and our AI Assistant Privacy Notice — form a legally binding agreement between you and TTS CLINICAL and describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They contain important provisions, including a disclaimer of warranties (Section 17), a limitation of liability (Section 18), and a governing-law clause (Section 23).

By accessing, browsing, or making a purchase through the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Section 1 — Eligibility and Your Account

You may use the Services only if you are at least 18 years of age (or the age of majority in your state of residence, if higher). If you allow a minor dependent to use the Services on a device you own or manage, you do so with your consent and under your supervision, and you remain responsible for their activity.

When you use the Services — including browsing, creating an account, or making a purchase — you may be asked to provide information such as your email address and billing, payment, and shipping details. You represent that all information you provide is accurate, current, and complete, and that you have the right to provide it. You agree to keep it updated.

You are solely responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at support@ttsclinical.com if you suspect unauthorized use. Accounts may not be sold, transferred, or shared.

Section 2 — Our Products

We make every reasonable effort to display our products accurately. However, the colors, textures, and appearance of cosmetics and personal care products may vary from what you see on screen, depending on your device and display settings. We do not warrant that a product's appearance will exactly match its depiction in our store.

Product descriptions, formulations, ingredients, and packaging may change at any time without notice. We reserve the right to discontinue any product and to limit the quantities of any product offered to any person, region, or jurisdiction on a case-by-case basis. Always refer to the ingredient list on the physical product you receive, which controls over any description on the website.

Section 3 — Product Use and Safety

Our products are cosmetics intended for external use only, in accordance with the directions on the label. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and nothing on the Services constitutes medical advice.

Before using any new product, review the ingredient list for known allergens and consider performing a patch test. Discontinue use immediately if irritation occurs and consult a healthcare professional. If you are pregnant, nursing, or have a medical condition or sensitive skin, consult your physician before use. Keep products out of reach of children.

Section 4 — Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion — for example, in cases of suspected fraud, pricing errors, or stock unavailability. Your order is accepted only when we send you a confirmation of acceptance, and we must receive and process your payment before acceptance.

Please review your order carefully before submitting it; we may be unable to accommodate changes or cancellations after an order is accepted. If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided with the order, and any amounts already charged will be refunded.

Returns, exchanges, and refunds are governed exclusively by our Refund & Return Policy. Subscriptions, pre-orders, and try-before-you-buy purchases are additionally governed by our Cancellation Policy.

You represent that your purchases are for personal or household use only, and not for commercial resale or export.

Section 5 — Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged is the price in effect at the time you place your order, as stated in your order confirmation email. Unless expressly stated otherwise, posted prices do not include taxes, shipping, handling, or customs and import charges, which are calculated and disclosed at checkout where applicable.

Prices in our online store may differ from prices offered in physical stores or by third-party retailers. Promotions may be governed by separate terms; if those terms conflict with these Terms, the promotion terms control for that promotion.

By providing a payment method, you represent that (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use that payment method; (iii) charges you incur will be honored by your card issuer or payment provider; and (iv) you will pay all charges at the posted prices, including shipping, handling, and applicable taxes.

Section 6 — Shipping and Delivery

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, weather, or other events outside our reasonable control. Title and risk of loss pass to you when we transfer the products to the carrier; however, this does not affect your rights under our Refund & Return Policy regarding orders that arrive damaged or are confirmed lost in transit. Section 7 — Intellectual Property

The Services and everything in them — including trademarks, brands, text, images, graphics, product photography, reviews, video, audio, and the design, selection, and arrangement thereof — are owned by TTS CLINICAL, its affiliates, or its licensors, and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent. Nothing in these Terms grants you any license or right under any patent, trademark, copyright, or other intellectual property of TTS CLINICAL, Shopify, or any third party, except as expressly stated. All rights not expressly granted are reserved.

TTS CLINICAL's names, logos, and product names are trademarks of TTS CLINICAL or its affiliates or licensors and may not be used without our prior written permission. Shopify's name and logo are trademarks of Shopify. All other marks are the property of their respective owners.

Section 8 — Optional Tools and Third-Party Links

The Services may give you access to third-party tools that we neither monitor nor control. We provide access to such tools "as is" and "as available," without warranties of any kind and without endorsement, and we have no liability arising from your use of them. Use of optional third-party tools is at your own risk, and you should review the applicable third-party terms before using them. Any new features or tools we add to the Services are also subject to these Terms.

The Services may also contain links to third-party websites or embedded third-party functionality. We are not responsible for the content, accuracy, or practices of third-party sites, and we are not liable for any harm or damages related to your use of them or your purchase of third-party products or services. Review the applicable third-party policies before transacting, and direct any claims regarding third-party products to the relevant third party.

Section 9 — Relationship with Shopify

TTS CLINICAL is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with TTS CLINICAL. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and TTS CLINICAL, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with TTS CLINICAL.

Section 10 — Privacy

All personal information collected through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information about your access to and use of the Services in order to provide and improve them; this processing is described in Shopify's Privacy Policy. Information you submit may be transmitted to and shared with Shopify and with service providers located in countries other than your own in order to provide the Services. By using the Services, you acknowledge that you have read these privacy policies.

Section 11 — Reviews and Feedback

If you submit reviews, ideas, suggestions, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium and for any purpose, including commercial and promotional use.

You represent that (i) you own or have all rights necessary to your Feedback; (ii) you have disclosed any compensation or incentive received in connection with it; and (iii) it complies with these Terms. Your Feedback must not infringe any third party's rights; must not be false, misleading, defamatory, obscene, or otherwise unlawful; and must not contain malware. You may not submit Feedback under a false identity.

We have no obligation to keep Feedback confidential, to compensate you for it, or to respond to it. We may — but are not obligated to — monitor, edit, or remove Feedback that we determine, in our sole discretion, violates these Terms or applicable law. You are solely responsible for your Feedback and its accuracy.

Section 12 — Errors, Inaccuracies, and Omissions

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct any such errors, to update information, and to cancel affected orders — including after you have submitted an order — without prior notice. If we cancel an order for this reason, any amounts charged will be refunded in full.

Section 13 — Prohibited Uses

You may use the Services for lawful purposes only. You may not use the Services, directly or indirectly, to: (a) violate any law or regulation; (b) infringe our intellectual property rights or those of others; (c) harass, abuse, defame, or harm any person, including our employees; (d) transmit false or misleading information; (e) send spam or other unsolicited promotional material; (f) impersonate any person or entity; or (g) engage in any conduct that restricts or inhibits anyone's use of the Services or that may harm or expose to liability TTS CLINICAL, Shopify, or users of the Services.

You further agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, copy, extract, sell, resell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the Services; (e) use any robot, spider, scraper, data-extraction tool, AI tool (including agentic AI), or other automated or manual means to access the Services except as permitted under Section 14; or (f) interfere with, bypass, or circumvent any security or access-control measure of the Services, including robot exclusion headers.

We reserve the right to suspend, disable, or terminate your account or access at any time, without notice, if we determine that you have violated any part of these Terms.

Section 14 — Automated Agents

14.1 This section applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, without direct supervision.

14.2 No Agent may access, use, or interact with the Services unless it identifies itself and operates in strict accordance with Section 14.4 at all times, and no Agent may do so after we have requested that it refrain.

14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, or interacts with the Services.

14.4 Agents must: (i) identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user-agent string; (ii) not conceal or obfuscate that access or interactions come from an Agent, including by mimicking human behavior or completing or circumventing CAPTCHAs or similar measures; (iii) respond truthfully to any prompt seeking to determine whether interactions come from a human or a computer; and (iv) not circumvent any measure intended to block, limit, or control Agent access to the Services.

Section 15 — Termination

We may terminate this agreement or your access to all or part of the Services at any time, in our sole discretion, without notice. You remain liable for all amounts due up to and including the date of termination.

The following sections survive termination: Intellectual Property (7), Reviews and Feedback (11), Termination (15), Disclaimer of Warranties (17), Limitation of Liability (18), Indemnification (19), Severability (20), Waiver; Entire Agreement (21), Assignment (22), Governing Law (23), Privacy (10), and any other provision that by its nature should survive.

Section 16 — Informational Content

Information presented on or through the Services is provided for general informational purposes only. We do not warrant its accuracy, completeness, or usefulness, and any reliance you place on it is at your own risk.

Section 17 — Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED BY TTS CLINICAL, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO SOME OR ALL OF THE ABOVE DISCLAIMERS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

Section 18 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TTS CLINICAL, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS — OR THOSE OF SHOPIFY AND ITS AFFILIATES — BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE PRODUCTS GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Section 19 — Indemnification

You agree to indemnify, defend, and hold harmless TTS CLINICAL, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

Section 20 — Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed. Such determination shall not affect the validity and enforceability of the remaining provisions.

Section 21 — Waiver; Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with the policies and operating rules posted by us on the Services, constitute the entire agreement between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written (including any prior versions of these Terms). Any ambiguity in the interpretation of these Terms shall not be construed against the drafting party.

Section 22 — Assignment

You may not delegate, transfer, or assign these Terms or any of your rights or obligations under them without our prior written consent; any attempt to do so is null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

Section 23 — Governing Law and Venue

These Terms, and any separate agreements whereby we provide you Services, shall be governed by and construed in accordance with the laws of the State of [State], United States, without regard to its conflict-of-law principles. You and TTS CLINICAL agree to submit to the exclusive jurisdiction and venue of the federal and state courts located in [County, State] for the resolution of any dispute arising out of these Terms or the Services, except where applicable law grants you the right to bring a claim in the courts of your state of residence.
